IP Partner Blaine Templeman Joins NY Office
Law Firm News | 2008/08/18 08:49
Blaine Templeman has joined the New York office of Sheppard, Mullin, Richter & Hampton LLP as a partner in the firm's Intellectual Property practice group.  He will head Sheppard Mullin's new Biotech Clinical Contracting team.  Templeman was most recently a partner in the New York office of Heller Ehrman.

Templeman focuses on U.S. and cross-border intellectual property transactions, drug manufacturing, and clinical trials outsourcing and contracting.  He completed one of the largest mergers in U.S. biotech history, and is one of only seven attorneys in the New York area who has been named as a Best Lawyer in America for Biotechnology Law.

"Blaine adds significantly to our expertise in life sciences, an area of strategic expansion in both transactional and litigation areas.  His biotech specialization is complementary to our existing strength in patent litigation and prosecution, food and drug regulation, and healthcare M&A.  We continue to grow signature groups like Life Sciences and IP, and Blaine's industry knowledge and experience is of great value to clients," said Guy Halgren, chairman of the firm.

IP partners Steve Hanle and Jennifer Trusso, who specialize in pharmaceutical and medical device patent litigation, joined Sheppard Mullin's Orange County office in July.  Corporate partner Eric Klein, whose focus is healthcare and life sciences M&A, joined the firm's Century City office in April.  Also in April, IP partner Karen Canaan brought her biotech patent expertise to Sheppard Mullin's Silicon Valley office.

Commented Templeman, "With a strong international IP practice group and growing Life Sciences capabilities, Sheppard Mullin offers a excellent platform for my practice.  I am excited to grow these areas even further and look forward to rejoining some former colleagues and friends."

Templeman’s transactional expertise includes asset deals, collaborations, licensing transactions, distribution arrangements and co-promotions.  He assists clients in a variety of life sciences areas, including medical devices, vaccines, antibiotics, diabetes, oncology, and sexual dysfunction.  Recent representative matters include: assisting a French client in out-licensing for North America a beta lactumase inhibitor to a U.S. pharma company, helping a U.S. client purchase the U.S. rights to an oncology treatment, setting up worldwide distribution arrangements including in the U.S., EU, Korea, and Russia, assisting a prominent Indian client with investments and collaborations with U.S. companies, negotiating dispute resolution when clinical trials are not being executed efficiently, and negotiating manufacturing arrangements for API, finished product and delivery systems.

As head of the firm’s new Biotech Clinical Contracting Team, Templeman will service clients’ needs with respect to clinical trials agreements, CRO agreements, master service agreements, laboratory agreements, manufacturing agreements (including development, API and finished product agreements), and research arrangements.  He has worked closely with several of his clients to complete transactions in the U.S., the EU, Russia, Australia, New Zealand, India, Japan, Korea, Taiwan, and many other countries.

Templeman received a J.D. from New York University School of Law in 1994 and a B.A., summa cum laude, from Oral Roberts University in 1988.

Sheppard Mullin has more than 40 attorneys based in its New York office.  The firm's Intellectual Property practice group includes 60 attorneys firmwide.

Evans & Petree, Bogatin Law Firm to merge
Law Firm News | 2008/08/01 01:32

The Bogatin Law Firm PLC, one of Memphis' oldest law firms, will dissolve on Friday.

10 Bogatin attorneys will be absorbed by law firm Evans & Petree PC, which employs 29 attorneys, in a merger that will create one of the top five Memphis-based law firms. A source familiar with the merger said the name Evans Petree Bogatin has been proposed to serve as the combined firm's moniker.

According to another source familiar with the deal, several Bogatin attorneys will not join the combined law firm, including: Stephen Biller, Stephen Brown, Susan Callison, Charles Cottam, Charles Key, Jack Magids and Robert Wilson.

Irvin Bogatin, founder of The Bogatin Law Firm, died last month.

Managing partners of Evans & Petree and Bogatin declined to comment.

In April, Memphis Business Journal reported on the planned dissolution of Bogatin and its merger with Evans & Petree. In October 2007, MBJ first reported on early merger talks between the two firms, which called for 20 Bogatin attorneys to be absorbed by Evans & Petree.

Located at 1000 Ridgeway Loop, Evans & Petree will now add Bogatin's strong litigation practice, which will compliment Evans & Petree's focus on transactional law, estate planning and corporate law, MBJ has reported. Both Bogatin and Evans & Petree practice in health care and tax law.

Atlanta law firm to absorb Weston Benshoof
Law Firm News | 2008/07/30 04:32

Alston & Bird LLP is putting its mark on California, with plans to absorb in September the Los Angeles law firm Weston Benshoof Rochefort Rubalcava & MacCuish LLP and its 83 attorneys. Weston Benshoof is known for its environmental and land use practices, but it also litigates in real estate, construction, and water resources issues.

Atlanta-based Alston & Bird also said Wednesday it has opened a 12-attorney office in Palo Alto. The addition of the new lawyers in California will bring the total number of attorneys at Alston & Bird to more than 900.

"Alston & Bird's continued growth is the result of our increasing national and international client base for whom our strategic approach is simple -- We will be where our clients are and need us to be," said Richard R. Hays, Alston & Bird's managing partner, in a prepared statement. "While Alston & Bird has been representing clients on the West Coast for years, teaming up with some of the best talent in Los Angeles and Silicon Valley gives us stronger footing in a number of key practice areas that will benefit our clients and better serve their needs."

Williams Mullen law firm moving to RBC Plaza
Law Firm News | 2008/07/24 05:32

Law firm Williams Mullen has signed a 75,000-square-foot lease to relocate to downtown Raleigh's RBC Plaza.

The building's owner, Raleigh's Highwoods Properties (NYSE: HIW), announced the lease Wednesday. It said the office space in 293,000-square-foot RBC Plaza, which is under construction, is now 95 percent preleased.

Williams Mullen will relocate from Highwoods Tower I in north Raleigh, where the law firm occupies 51,000 square feet. The company plans to move to RBC Plaza in the third quarter of 2009.

"We are excited to be moving to RBC Plaza and the heart of downtown Raleigh," Williams Mullen director Keith Kapp said in a statement. "This is a great opportunity for us to be in a central location in the newest office building in the city. We have been customers of Highwoods for many years and are very pleased to be able to extend this mutually beneficial relationship."

Triangle Business Journal first reported that Williams Mullen was looking to take space in the RBC Plaza.

The RBC Plaza, a 29-story tower that is the tallest building in the Triangle, is scheduled to open this fall with a mix of office, retail and condominium space. All 139 condominiums are under contract with non-refundable deposits, Highwoods says.

The Dallas-based technology law firm of Munck Carter, P.C., is strengthening its litigation section with the addition of attorneys James B. Hamilton and Laura A. Russell.

"We are excited to welcome James and Laura to the firm," says Jamil N. Alibhai, Chairman of the firm's Litigation Section.

A lieutenant in the U.S. Navy Reserve, he earned his undergraduate degree in Maritime Operations and Technology from the United States Merchant Marine Academy, and has served as a licensed cargo and navigation officer aboard supertankers and other vessels in domestic and international waters.

Report shows law firm mergers are up
Law Firm News | 2008/07/09 08:48

The second quarter of this year saw the pace of law firm mergers rise sharply in the U.S., according to a new report from legal consultancy Altman Weil Inc.

There were 26 new law firm mergers and acquisitions reported in April, May and June, compared to 18 during the first quarter of the year, according to Newtown Square, Pa.-based Altman Weil.

The largest of the latest law firm combinations was between K&L Gates, a 1,500-attorney firm, and Kennedy Convington Lobdell & Hickman, a 175-lawyer firm.

In Memphis there were no significant mergers reported for the quarter. However, in the previous quarter St. Louis-based Husch & Eppenberger LLC and Kansas City, Mo.,-based Blackwell Sanders LLP finalized their merger, which was first announced last September. Of the two, only Husch & Eppenberger had an office in Memphis.

In July 2007, Memphis-based Baker, Donelson, Bearman, Caldwell & Berkowitz PC merged Atlanta-based Gambrell & Stolz LLP into the firm, adding 36 attorneys.

"Even in a deteriorating economy, law firms continue to pursue a growth strategy via merger and acquisition," said Altman Weil principal Tom Clay in a statement. "And based on our conversations with law firm leaders, we think the pace is unlikely to slow."

New Albany law firm has San Francisco, NYC offices
Law Firm News | 2008/06/10 02:43

Ronald D'Alessandro has started a law firm, Keohane & D'Alessandro PLLC with offices in San Francisco, New York City and Albany, N.Y. "My partner is in San Francisco," said D'Alessandro. D'Alessandro, 35, met his law partner, Stephen Keohane about seven years ago when Keohane was counsel for IBM. "He was one of my best clients," D'Alessandro said. A senior associate, Darrell Pogue, is based in New York City.

D'Alessandro was one of the founders of the Albany intellectual property firm Hoffman, Warnick & D'Alessandro LLC. Michael Hoffman, Spencer Warnick and D'Alessandro started the firm about nine years ago when they met while working at another firm, Schmeiser Olsen & Watts LLP in Latham.

Last week, it was announced that the firm was rebranding, calling itself Hoffman Warnick LLC. D'Alessandro said he enjoyed starting up another firm.

"I didn't realize how much fun it was to be back at the grass roots," he said. "Each day can bring something different. You never know what the next day will bring. It can bring headaches but also a lot of interesting challenges."

It took a week for the furniture to arrive at his new office at 1881 Western Ave.

Class action or a representative action is a form of lawsuit in which a large group of people collectively bring a claim to court and/or in which a class of defendants is being sued. This form of collective lawsuit originated in the United States and is still predominantly a U.S. phenomenon, at least the U.S. variant of it. In the United States federal courts, class actions are governed by Federal Rules of Civil Procedure Rule. Since 1938, many states have adopted rules similar to the FRCP. However, some states like California have civil procedure systems which deviate significantly from the federal rules; the California Codes provide for four separate types of class actions. As a result, there are two separate treatises devoted solely to the complex topic of California class actions. Some states, such as Virginia, do not provide for any class actions, while others, such as New York, limit the types of claims that may be brought as class actions.
