At its simplest level, the impeachment of President Donald Trump looks like a collision between the legislative and executive branches of government. In that fight, each side is trying to defend its prerogatives as it sees them: For Congress (or at least the Democratic-led House), this includes the power to appropriate foreign aid, and the power to conduct oversight; for the executive branch, this means the power to make foreign policy as it sees fit, and to protect its internal deliberations.
What is missing from this portrait is the crucial role of the third branch of government, the judiciary, which has powerfully shaped the impeachment process by declining to exercise its prerogatives, rather than defending them. By choosing to treat the current moment as business as usual, federal courts have effectively removed themselves from the process. In effect, that has dictated what arguments can be mounted in the impeachment fight and what witnesses Congress, and the public, can hear?narrowing and obscuring the case against Trump.
None of this absolves Democrats of the decisions they’ve made. The House majority could have chosen to fight in court to compel testimony from current and former administration officials, especially former National Security Adviser John Bolton. Those fights would not have been resolved in time to hold an impeachment vote before Christmas, but that deadline is self-imposed and politically motivated. Democrats could have waited, or they could have pursued the court battle while also charging ahead.

Top Pakistan court bars former minister from holding office

Pakistan's top court has barred the former deputy interior minister from holding office for the next five years for insulting judges in a speech earlier this year.
Thursday's ruling by the Supreme Court says Talal Chaudhry, who was deputy interior minister under former Prime Minister Nawaz Sharif, disparaged judges during a March speech.
In the speech, Chaudry assailed the top court for dismissing Sharif from office. The former prime minister is now appealing a 10-year prison sentence for corruption handed down by an anti-graft tribunal in June.
Sharif's party — the Pakistan Muslim League — was defeated in general elections last month that saw former cricket star turn politician Imran Khan's party win the vote.
Khan is expected to form a coalition government and become prime minister later this month.

Prosecutor to press court to release church abuse report

Pennsylvania's highest court is being pressed to publicly release a major grand jury report on allegations of child sexual abuse and cover-ups in six of the state's Roman Catholic dioceses.
Pennsylvania Attorney General Josh Shapiro will ask the court to swiftly decide lingering legal issues before it, his office said Friday. He expects to make that request Monday.
"The people of Pennsylvania have a right to see the report, know who is attempting to block its release and why, and to hear the voices of the victims of sexual abuse within the Church," Shapiro said in a statement.
The state Supreme Court is blocking the release of the report as the result of legal challenges filed under seal by people apparently named in the report. The court has declined to make those filings or dockets public, or name the people who filed the challenges.
The Supreme Court's chief justice, Thomas Saylor, declined comment through a spokeswoman, and lawyers for the unnamed people challenging the report did not respond to requests for comment.
Meanwhile, seven news organizations, including The Associated Press, on Friday filed a motion to intervene in the case in a bid to argue that the court should release the report, contending that it is required by law. If the court decides it needs more time to consider the legal challenges, it could immediately order the report's release with only those parts that are in question shielded from view, lawyers for the news organizations wrote.
The court also should be consistent with practice in other grand jury matters and make public the filings and dockets in the case, with redactions if necessary, the news organizations wrote.
Victim advocates have said the report is expected to be the largest and most exhaustive such review by any state. The grand jury spent two years investigating allegations of child sex abuse in the dioceses of Allentown, Erie, Greensburg, Harrisburg, Pittsburgh and Scranton, churches with some 1.7 million members.

Egypt refers 28 to criminal court for forming illegal group

Egypt's chief prosecutor has referred 28 people to a criminal court on charges including forming an illegal group aiming to topple the government.
Sunday's statement by prosecutor Nabil Sadek says the suspects face an array of additional charges, including inciting violence and disseminating false news.
The statement says the suspects formed an illegal group, "The Egyptian Council for Change," to incite against the state and its institutions.
It says only nine of the 28 suspects are in custody. No date has been set for the trial. Egypt has intensified a long-running crackdown on dissent since President Abdel-Fattah el-Sissi's re-election in March.
The arrests are part of a wider crackdown on dissent since the 2013 military ouster of an elected Islamist president following mass protests against his one-year divisive rule.

Court allows Pennsylvania to redraw GOP-favored district map

Justice Samuel Alito, who handles emergency appeals from Pennsylvania, rejected the request from GOP legislative leaders and voters to put on hold an order from the state Supreme Court intended to produce new congressional districts in the coming two weeks.
The Pennsylvania high court ruled last month that the current map of 18 districts violates the state constitution because it unfairly benefits Republicans.
The decision comes just four days before the Republican-controlled Legislature's deadline for submitting a replacement map for Democratic Gov. Tom Wolf to consider. So far, there has been a notable lack of bipartisan movement on getting such a deal.
Pennsylvania's congressional delegation has been 13-5 in favor of Republicans during the three election cycles since the GOP-drawn 2011 map took effect, and experts have said those 13 seats are several more than would have been produced by a nonpartisan map.
Democrats have about 800,000 more registered voters than Republicans and hold all three elected statewide row offices, but Republicans enjoy solid majorities in both chambers of the Legislature.
Under the process laid out two weeks ago by four of the seven Pennsylvania Supreme Court justices, all Democrats, the Legislature has until Friday to approve a new map, after which Wolf will have until Feb. 15 to decide whether to endorse it and submit it to the justices.
Senate Republican Leader Jake Corman said Monday he's had "zero" discussions with Wolf and legislative leaders about new district boundaries and could not guarantee he will meet the deadline.
The state Supreme Court said it expects new districts to be in place by Feb. 19, and the new map is expected to be in play for the May 15 congressional primaries.

Judge to pick battlefield for court fight over Manson's body

Charles Manson orchestrated murders in his adopted hometown of Los Angeles, served time in a state prison in Corcoran and died in a hospital in Bakersfield.
The legal battle for his body or possessions could land in any of three California counties where those cities are located as friends and purported kin wage a court fight Friday that includes nasty accusations about profiteering off the death of the cult leader.
At least three parties have staked claims to collect Manson's body from the Kern County morgue two months after he died and take control of any assets, which could include potentially lucrative rights to the use of his image and songs he wrote and any other property.
"It's a circus show," said a frustrated Ben Gurecki, one of two pen pals who hold dueling wills allegedly signed by Manson. "It's despicable that I'm still sitting here 60 days later and I can't get my friend cremated."
But first a Los Angeles Superior Court judge must decide which court takes up the separate issues of Manson's remains and his estate.
A Florida man, Jason Freeman, claims he's a grandson and the rightful heir and that the killer left no will. He's been challenged in Los Angeles by Michael Channels, another pen pal and collector of Manson memorabilia, who holds a will bearing what appears to be Manson's signature and names him as executor and sole beneficiary.
Gurecki, who like Channels also sells Manson mementos to fans of so-called murderabilia, has filed a will with the Kern County coroner's office bearing Manson's purported signature. It names Gurecki as executor and leaves everything to his "one living child," Matthew Lentz, a Los Angeles musician. Lentz and Gurecki have yet to file the will in court. |
