U.S. Supreme Court voids overall contribution limits

The Supreme Court struck down limits today in federal law on the overall campaign contributions the biggest individual donors may make to candidates, political parties and political action committees.

The justices said in a 5-4 vote that Americans have a right to give the legal maximum to candidates for Congress and president, as well as to parties and PACs, without worrying that they will violate the law when they bump up against a limit on all contributions, set at $123,200 for 2013 and 2014. That includes a separate $48,600 cap on contributions to candidates.

But their decision does not undermine limits on individual contributions to candidates for president or Congress, now $2,600 an election.

Chief Justice John Roberts announced the decision, which split the court's liberal and conservative justices. Roberts said the aggregate limits do not act to prevent corruption, the rationale the court has upheld as justifying contribution limits.

The overall limits "intrude without justification on a citizen's ability to exercise 'the most fundamental First Amendment activities,'" Roberts said, quoting from the court's seminal 1976 campaign finance ruling in Buckley v. Valeo.

Justice Clarence Thomas agreed with the outcome of the case, but wrote separately to say that he would have gone further and wiped away all contribution limits.

Ex-Mass. chemist pleads not guilty in lab case

A former Massachusetts chemist accused of faking test results at a state drug lab has pleaded not guilty at her sixth and final arraignment.

Annie Dookhan was arraigned Monday on a charge of misleading a grand jury prosecutor and judge. She and her attorney declined to comment after the brief hearing. She has been free on $10,000 bail and prosecutors did not ask the judge in Salem to increase it.

Dookhan is accused of falsely claiming she holds a master's degree in chemistry while testifying as an expert witness. She has already pleaded not guilty to a string of charges in five other counties.

Dookhan was indicted in December on a total of 27 charges related to her alleged misconduct at the lab.

The scandal could jeopardize thousands of criminal cases.


High court fight looms over right to carry a gun

The next big issue in the national debate over guns — whether people have a right to be armed in public — is moving closer to Supreme Court review.

A provocative ruling by a panel of federal appeals court judges in Chicago struck down the only statewide ban on carrying concealed weapons, in Illinois. The ruling is somewhat at odds with those of other federal courts that have largely upheld state and local gun laws, including restrictions on concealed weapons, since the Supreme Court's landmark ruling declaring that people have a right to have a gun for self-defense.

In, 2008, the court voted 5-4 in District of Columbia v. Heller to strike down Washington's ban on handgun ownership and focused mainly on the right to defend one's own home. The court left for another day how broadly the Second Amendment may protect gun rights in other settings.

Legal scholars say the competing appellate rulings mean that day is drawing near for a new high court case on gun rights.

The appeals court ruling in Chicago came early in a week that ended with the mass shooting in Connecticut that left 28 people dead, including 20 children at an elementary school and the presumed gunman.

Former U.S. Attorney Patrick Fitzgerald has a new job. Fitzgerald plans to join Skadden, Arps, Slate, Meagher & Flom LLP. Fitzgerald will become a partner in the corporate law firm's Chicago office on Oct. 29.

Ads by GoogleDuring his tenure as U.S. attorney, Fitzgerald gained recognition for leading investigations into terrorism and organized crime, as well as the prosecutions of two Illinois governors. He stepped down as the top federal prosecutor in Chicago earlier this year.

Fitzgerald says he picked Skadden over other large firms because of its global reach and the opportunity to do some public-interest work.

Skadden has about 1,800 lawyers in 23 offices around the world, including about 170 attorneys in Chicago.
